Agreement With Users :
** This agreement is entered between Midas Portal Services Pvt. Ltd., a company incorporated under the Companies Act, 1956 and having its registered office at 908, ILD Tower, Sohna Road, Sector 47, Gurgaon-122001, Haryana, India (hereinafter referred to as “the Company”) through its website and ‘You’ as a visitor on the Website, hereinafter referred to as “User” (which expression shall, unless repugnant to the meaning or context hereof, be deemed to include its successors and permitted assigns).
** The terms and conditions set out in this agreement shall be valid and enforceable from the date of its acceptance. You should proceed to browse the Website or avail its Services only if you accept this Agreement by clicking on ‘I Agree’ button placed at the web page.
** Whereas onlineschooladmissions.com is a website (“Website”) owned and managed by the Company that provide information to Users about various schools that are registered on the Website (“School”) and facilitate them to post their enquiries online to such Schools.
** And Whereas the User being aware about the multiple benefits of utilizing Services of the Website, intends to avail the Company’s Services;
** NOW, THEREFORE, in consideration of the promises, mutual representations, warranties and covenants set forth herein, the Parties, out of their free will and consent, have entered into this Agreement and the Parties intending to be legally bound, hereby agree as follows :
Interpretation :
** The headings to Clauses, Sub-clauses and paragraphs of this Agreement shall only serve the purpose of easier orientation and shall not affect the contents and interpretation of this Agreement.
** All references in this Agreement to statutory provisions shall be construed as meaning and including references to : (i) any statutory modification, consolidation or re-enactment as of the date of this Agreement; (ii) all statutory instruments or orders made pursuant to a statutory provision; and (iii) any statutory provisions of which these statutory provisions are a consolidation, re-enactment or modification.
** Words denoting the singular shall include the plural and words denoting any gender shall include all genders.
** References to recitals and / or clauses are, unless the context otherwise specifically requires, to Recitals of, to Clauses of this Agreement.
** Reference to days, months and years are to English calendar days, calendar months and calendar years, respectively.
** Any reference to “writing” shall include printing, typing, lithography and other means of reproducing words in visible form.
** The words “include” and “including” are to be construed without limitation.
Acceptance of the Company as Facilitator :
The User hereby accepts the Company as online information service provider which will facilitate the User in accessing information about various schools which are registered with its website, and post their enquiries online to seek necessary clarifications.
Description of Services to be offered by the Company :
** The User shall be allowed to create an account by filing an e-form provided on the Website. Pursuant to submission of this form, the User shall be able to create a secure login ID and password for that account. The User, for the purpose of authentication of his / her account, shall be liable to provide a valid e-mail address and a phone number at the time of creation of account. Unless such e-mail address and phone number will be submitted, the User’s account shall not be activated.
** The Company shall allot a unique identification number to each of the User so as to identify and distinguish each of them, on creation of the account by the User. This unique identification number must be quoted by the User in all his/her transactions and correspondence with the Company. This unique identification number cannot be altered at any point of time.
** The User shall be liable to pay non-refundable registration fee with applicable taxes to the Company as per its policy from time to time.**
** The User shall at all times be responsible for maintaining secrecy and confidentiality of his/ her User ID and Passwords allotted to a User.
** Only those users shall be eligible to register with the website and avail its services who have completed minimum 18 years of age and are otherwise competent to enter into a contract as per the ‘Indian Contract Act, 1872’
** The Company shall display on its Website information about various Schools which are registered with its website. The User, on creation and activation of his account, can post his queries online to the Schools using the facilities available at website.
Confidentiality of Data :
Save as otherwise provided in this Agreement, the Company shall make reasonable endeavours to secure and maintain all data/information collected from the User. The information collected from the User shall be collected and disclosed only to the Schools, wherever required. The information may be disclosed when the disclosure is required by a law, regulation, court order or other legal mandate.
Prohibited activities :
In consideration of being allowed to use the Website, the User agrees that the following actions shall constitute a material breach of these Terms and Conditions :
