Track Order Terms & Conditions :

1.  McDonald’s India (West and South) is running McDelivery Service (hereinafter referred to as “McDelivery”).

2 . McDelivery is specially designed for customers who place orders through McDelivery on the McDelivery Number i.e. 66 000 666 (“McDelivery Number”) at McDelivery restaurants located anywhere in West and South India operated by Hardcastle Restaurants Private Limited (“HRPL”) and its franchisee.

Customers residing at or placing an order from the city of Pune, have to prefix the McDelivery Number 66 000 666 with the STD code 022 or the STD code of the city in which the McDelivery Order is to be delivered. Customers residing at or placing an order from any city other than Pune, have to prefix the McDelivery Number 66 000 666 with the STD code of the city in which the McDelivery Order is to be delivered.

3.  It shall be the responsibility of the customer to ensure that delivery instructions are clear and concise.
4.  The acceptance of order shall be at the entire discretion of HRPL.

5 . It is clarified that McDelivery is not available at all restaurants of McDonald’s India/HRPL. Please check with the McDelivery Call Center at 66 000 666 to confirm whether McDelivery is available in your area.
a. Customer addresses falling in the delivery area (area within which McDelivery is available) of the nearest restaurant. The delivery area is defined from time to time by HRPL at its discretion and is subject to change.
b. The delivery address being mapped to the nearest restaurant that delivers in customer area.
c. Availability of McDonald’s products.
d. In case the delivery locality is not listed in the restaurant map, delivery orders cannot be placed.

6.  HRPL reserves the right, in its sole discretion, without limitations, conditions and/or qualifications, and without need of prior notification, to limit, change, modify or cancel any order, and/or to refuse any service to any customer for any reason attributable to the unavailability of the items ordered, or other circumstances and conditions beyond the control of HRPL’s which would render impossible or delay the fulfillment of its obligations.

7.  HRPL reserves the right to refuse or to accept or to cancel any order from any customer beyond the delivery area or otherwise.

8. Delivery orders are subject to:
a. Once the order has been placed it cannot be changed or cancelled by the customers for any reason.
b. The prices of the McDonald’s products are inclusive of Value Added Tax (VAT) but exclusive of service taxes and delivery charges.
c. The customer is liable to pay delivery charges (at present Rs. 25/- (Rupees Twenty Five)) per order placed through McDelivery plus service tax and other taxes as may be applicable from time to time.

d. HRPL shall use its best efforts to meet the scheduled delivery time conveyed by the McDelivery Call Center on the phone to the customer, however, it does not guarantee these delivery timelines in every case. HRPL shall not have any liability to customer if the customer’s order fails to meet in whole or in part such scheduled delivery time.

e. It is customer’s responsibility to ensure that customer himself/herself or an appropriate person is available at the delivery address and he/she must pay in full for the order placed through McDelivery. If customer or appropriate person fails to be present for McDelivery, HRPL is entitled to charge the customer in full the amount of order and the cost of delivery

f. Upon delivery, customer shall pay in cash all fees and charges (including delivery charges mentioned above) incurred in connection with the order, including any and all applicable taxes, at the rate in effect when the charges were incurred. Alternately, while placing the order on the McDelivery website mcdelivery.co.in, customers may choose the online payment option, upon which they shall be redirected to an external payment gateway, on which they are required to follow the payment gateway’s separate instructions for effecting online payment.

** The payment gateway is not under HRPL’s control, and HRPL is not responsible for and shall not be liable to any extent or in any manner for any payment-related or internet-related issues faced by customers in relation to online payments, and customers shall indemnify and keep fully and effectively indemnified HRPL and its affiliates in this regard.

9. HRPL reserves the right to reject the Delivery order or to cancel the same once it is accepted:
a. In case HRPL is unable to contact the customer due to any reason whatsoever on the mobile / landline number of the customer as provided by the customer at the time of placing the order;
b. In case of non receipt of payment in full or in part in any previous order
c. In case of abuse to any employee/ representative /riders of HRPL in any previous incident
d. If there is a trend of order cancellations
e. If there is a trend of frequent complaints and consequent replacements
f. If customer has provided wrong, inaccurate, incomplete or incorrect address
g. If customer’s address is not falling in defined delivery area of the nearest or any other restaurant or beyond the delivery area of HRPL
h. In view of difficult operating conditions for McDelivery like heavy traffic or bad weather condition or New ’Year’s eve, during Ganesh festival, Christmas and Navratri, political rallies etc.
i. In any other event at the sole discretion of HRPL, without the need to assign any reason or explanation.

10. Menu and prices are subject to change without notice.
11. HRPL may change the terms of, or add new terms to, these Terms and Conditions at any time, with or without cause, and without giving notice.
12. In case of any dispute with respect to McDelivery, the decision of HRPL shall be final and binding on all concerned. Disputes, if any, are subject to the jurisdiction of the competent court/s at Mumbai only.
13. It is clarified that, by placing an order/s through McDelivery Number, a customer unconditionally and fully accepts all above terms and conditions of McDelivery.
14. All promotional codes can be redeemed only once on a mobile number.
15. This promotion is valid only on McDelivery. It will be valid on call ie by calling 66000666 and on web by login in to mcdelivery.co.in.
